1. The Promoter

The promoter is OnlyWins UK ("Promoter", "we", "our", "us") who operates various competitions resulting in the allocation of prizes ("Prize" or "Prizes") on the website www.onlywins.uk ("Platform") in accordance with these terms and conditions.

2. The Competitions

  1. All draws operated by the Promoter on its Platform to win Prizes are referred to as the "Competition(s)" in these Terms and Conditions.
  2. Multiple Competitions may be operated at the same time by the Promoter on the Platform. Each Competition will have a specific Prize as specified on the Platform.
  3. Availability and pricing of Competitions is at the discretion of the Promoter and will be specified on the Platform.
  4. Each Competition may include a free entry route as well as a paid entry route (see Section 4). Where a free entry route is available, the Competition does not fall within the definition of a lottery under the Gambling Act 2005 and can be operated legally in Great Britain without a licence.
  5. Each Competition will run for the period of time specified on the Platform ("Promotion Period"). The Promoter may end the Promotion Period earlier at its discretion, provided that the Competition will remain open for at least 3 clear days following announcement on the Platform.
  6. The Competition will end when all tickets are sold or the Promotion Period expires, whichever occurs first. No further entries will be accepted after this point.

3. Eligibility

  1. Competitions are open to all persons aged 18 or over who are resident in a country where it is lawful for them to enter.
  2. Any employees of the Promoter or any person connected with the Promoter (through immediate family, professional or commercial association) are prohibited from participating.
  3. By entering a Competition, the entrant ("Entrant", "you", "your") undertakes that you:
    • are at least 18 years of age;
    • have the legal capacity to enter;
    • have read, understood and accepted these Terms and Conditions; and
    • will be bound by them and by any requirements set out in promotional material on the Platform.
  4. By participating in a Competition, you confirm that you are not breaching any laws in your country of residence. The Promoter will not be held responsible for any Entrant entering unlawfully.
  5. The Promoter reserves the right to refuse any entry at its own discretion.
  6. All Competitions are governed by English law. Any matters or disputes will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

4. How To Enter

  1. To enter any Competition, you must first create an account on the Platform. You will be asked to provide an email address or sign in via a supported authentication method.
  2. All Entrants must provide their contact details including:
    • full name;
    • email address; and
    • any other details as requested on the Platform.
  3. To enter online, follow the on-screen instructions to select the Competition you wish to enter, choose the number of tickets, and complete payment. Once your payment has cleared, we will confirm your entry.
  4. Free postal entries may be submitted by sending an open postcard to our registered address 35 Navenby Rd, Wigan, WN3 5QJ, specifying which Competition you wish to enter and providing your contact details. Postal entries will be allocated random ticket numbers in the same manner as paid entries and have the same chance of winning.
  5. All entries must be received by the end of the Promotion Period. If a Competition has sold out, no further entries will be accepted.
  6. You will not be deemed entered until we confirm your entry, which can be verified in your account.
  7. The Promoter reserves the right to refuse or disqualify any incomplete entry, or any entry where there are reasonable grounds for believing that these Terms and Conditions have been contravened.
  8. All entries are final and no refunds will be made, except as set out in these Terms.

5. Competition Draw & Winner Selection

  1. The winner of each Competition ("Prize Winner") will be selected using a verifiably random method at the discretion of the Promoter. The draw may be live streamed or recorded and made available on the Platform or via social media.
  2. In the event of any malfunction or technical error in the selection process, the Promoter shall be entitled to re-run the winner selection.
  3. There will be only one Prize Winner per Competition unless stated otherwise on the Platform. The Promoter's decision is final.
  4. The Promoter will attempt to contact Prize Winners using the contact details provided at the time of entry. It is your responsibility to ensure your details are accurate and up to date.
  5. If the Promoter is unable to contact a Prize Winner within five (5) working days of the end of a Competition, or the Prize Winner fails to confirm acceptance, the Prize will be forfeited and remain in possession of the Promoter.
  6. The Promoter will draw a Prize Winner at the end of the Promotion Period. There will be no extensions. The Promoter may bring the draw date forward if the maximum number of entries has been reached.
  7. The Promoter reserves the right to cancel any Competition at any time. If cancelled, each Entrant will be notified and payments will be refunded or credited towards future Competitions.

6. Prizes

  1. Details of each Prize can be found on the Platform. The Promoter takes no responsibility for the Prize after delivery to the Prize Winner.
  2. Delivery of monetary prizes will be made directly to the Prize Winner's verified personal bank account. Under no circumstances will winnings be transferred to any third party.
  3. Prize Winners will be required to show documentary proof of their age (18+) and identification prior to receiving a Prize. Failure to provide this may result in disqualification.
  4. All expenses related to collecting or receiving a Prize are the sole responsibility of the Prize Winner, including any applicable taxes, duties or charges.
  5. Prizes must be accepted as awarded. Prizes are non-transferable and cannot be exchanged for other items.
  6. Where offered by the Promoter, Prize Winners may have the option to receive a cash alternative reasonably equivalent to the Prize.

7. Prize Winner's Personal Data

  1. Prize Winners may be asked to provide photographs and/or consent to promotional use of their name and likeness by the Promoter.
  2. Entrants have the right to withhold consent to promotional use of their details, but the Promoter may use a Prize Winner's first name and general location when announcing results.

8. Limitation of Liability

  1. Except for liability for death or personal injury caused by negligence, or for fraudulent misrepresentation, the Promoter shall not be liable for any loss suffered in connection with the Competition or Prize.
  2. The total maximum aggregate liability of the Promoter to each Prize Winner shall be limited to the total value of the Prize won.
  3. The total maximum aggregate liability to an Entrant who is not a Prize Winner shall be limited to the amount paid to enter Competitions in the first 12 months of participation.
  4. Nothing in these Terms shall prevent you from exercising your statutory rights.

9. Electronic Communications

No responsibility will be accepted by the Promoter for failed, partial or garbled transmissions, or for any hardware, software, network or internet failures. The Promoter shall use reasonable endeavours to ensure the Platform performs correctly. Only entries recorded in our systems shall be valid.

10. Data Protection

  1. Any personal data you supply will be processed to administer the Competition and fulfil Prizes, as set out in our Privacy Policy.
  2. The Promoter may disclose data to payment processors, legal authorities, and successors in business as necessary.
  3. Where data is transferred outside the United Kingdom, the Promoter is responsible for ensuring adequate protection.

11. Your Account

  1. You must keep your account credentials secure and secret at all times. Never share your password with anyone.
  2. Contact the Promoter immediately if you believe your account has been accessed without your permission.
  3. The Promoter shall not be liable for any consequences arising from unauthorised access to your account due to your failure to keep credentials secure.

12. Payments & Chargebacks

  1. If you dispute any payment, contact us immediately to discuss. All wallet top-ups are processed via Square.
  2. In the event of an unjustified chargeback, the Promoter reserves the right to recover costs and terminate your account.

13. Use of the Platform

  1. The Platform is for your personal, non-commercial use only.
  2. You must not transmit harmful content, attempt to hack or impair the Platform, or authorise anyone else to do so.
  3. All content, trademarks and intellectual property on the Platform belong to the Promoter. You must not copy, distribute or reverse-engineer any part of the Platform.

14. Changes

We may revise these Terms from time to time. The most current version will be posted on the Platform. By continuing to use the Platform after changes take effect, you agree to be bound by the revised terms.

15. General

  1. Failure or delay by the Promoter to enforce any provision is not a waiver of the right to do so later.
  2. If any provision is found void or unenforceable by a court, the remaining provisions shall continue in full force.
  3. You may not assign or transfer your rights under these Terms. The Promoter may assign its rights to any successor in business.
  4. These Terms constitute the entire agreement between you and the Promoter regarding the Competitions.
  5. The Promoter will not be liable for delays or failures caused by events beyond its reasonable control, including acts of God, labour disputes, power outages, natural disasters, or government action.
